This Privacy Policy explains how LandForms ("LandForms", "we", "us") collects, uses, and shares personal information when you visit our website at uselandforms.com, sign up for an account, fill out a public form built on LandForms, or otherwise use our services (collectively the "Service"). By using the Service you agree to this Policy.
1. Roles
For accounts and billing, LandForms is the controller of your personal information. For form submissions, LandForms acts as a processor on behalf of the customer who created the form (the "Form Owner"); the Form Owner is the controller of submission data and is responsible for providing notice to and obtaining consent from form respondents.
2. Information We Collect
Account information: name, email address, password (handled by our authentication provider Kinde), organization name, and branding (logo, colors).
Billing information: if you subscribe to a paid plan, our payment processor Stripe collects your payment details. We do not store full card numbers; we only store the last four digits and a token so we can match invoices to your account.
Form submission data: when a respondent fills out a public form, we collect the data they enter (which may include name, email, phone, free-text fields, file uploads), the GPS coordinates of any pin they drop, the reverse-geocoded street address for that pin, and the PLSS legal description. The Form Owner controls what fields are collected and how that data is used.
Usage and device information: we automatically collect IP address, browser type, operating system, referring URL, pages visited, and timestamps. We use a small number of strictly necessary cookies to keep you signed in and to remember preferences. We do not use third-party advertising cookies.
Communications: if you email us, we keep your message and our reply.
3. How We Use Information
- provide, operate, secure, and improve the Service;
- create and manage your account;
- process payments and prevent fraud;
- send transactional messages (submission notifications, confirmation emails, billing receipts, security alerts);
- respond to your support requests;
- comply with legal obligations and enforce our Terms; and
- occasionally send service announcements (you may opt out of non-essential email at any time).
We do not sell or rent personal information, and we do not use form submission data to train machine-learning models or to advertise to you or your respondents.
4. How We Share Information
We share personal information only in these limited circumstances:
- Subprocessors: infrastructure and SaaS providers we rely on, currently Fly.io (hosting), Kinde (authentication), Stripe (billing), Resend (transactional email), Google Maps (mapping & geocoding), and Land Map Magic (PLSS). They process data only on our behalf and are bound by appropriate confidentiality and security obligations.
- Form Owners: if you submit a public form, your submission is delivered to the Form Owner who created it. The Form Owner's use of your data is governed by their own privacy policy.
- Legal requirements: to comply with a subpoena, court order, or other legal process, or to investigate fraud, security, or violations of our Terms.
- Business transfers: in connection with a merger, acquisition, financing, or sale of all or part of our business, subject to standard confidentiality protections.
5. Data Retention
We retain account information for as long as your account is active. When you delete your account, we permanently delete your forms, submissions, and uploaded files within 30 days. Backups containing your data may persist for an additional 30 days before being purged. We may retain a minimal record (email and account ID) longer if required to meet legal, accounting, or fraud-prevention obligations.
Form Owners can delete individual submissions at any time from the dashboard. Submissions deleted by a Form Owner are removed from active systems within 24 hours and from backups within 30 days.
6. Security
We use industry-standard safeguards including TLS encryption in transit, encryption at rest for our managed databases, role-based access controls, audit logging, and regular backups. No system is perfectly secure; if we ever learn of a breach affecting your data, we will notify you and the applicable authorities as required by law.
7. International Transfers
LandForms is operated from the United States. If you access the Service from outside the U.S., your information will be transferred to and processed in the U.S. and other countries where our subprocessors operate. Where required by law, we use appropriate transfer mechanisms (e.g., Standard Contractual Clauses) to safeguard transfers.
8. Your Rights
Depending on where you live, you may have the right to access, correct, delete, port, or restrict processing of your personal information, to object to certain processing, or to withdraw consent. You can exercise most of these rights directly from your dashboard's Settings page (e.g., editing your profile, deleting your account). For any other request, email hello@uselandforms.com. We will respond within the time required by applicable law (generally 30 days). California residents have additional rights under the CCPA; we do not "sell" or "share" personal information as those terms are defined under the CCPA.
If you are a form respondent and want to access or delete your submission data, contact the Form Owner directly. If you cannot reach them, we will help you reach them on a best-effort basis.
9. Children
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, please contact us and we will delete it.
10. Cookies
We use a small set of strictly necessary cookies, primarily a session cookie to keep you signed in and a CSRF token cookie. We do not use cross-site advertising trackers. If we ever add analytics, we will update this Policy and (where required) add a cookie banner.
11. Changes to This Policy
We may update this Policy from time to time. The "Last updated" date at the top reflects when changes take effect. If a change is material, we will provide reasonable notice (e.g., by email or an in-app banner) before it takes effect.
